N26 Bank GmbH ("the Bank") offers the N26 Account, a current account held in Euros, which can be managed solely online via digital banking services through N26's web portal or mobile application. The Bank is a licensed credit institution subject to regulation and supervision by BaFin and the Deutsche Bundesbank under applicable EU and national banking law.
2.1 Access to N26 eBanking services requires that the Account Holder maintain a valid Registration and at least one active Authentication Instrument. The Bank reserves the right to modify, restrict, or discontinue any feature of the eBanking services at any time upon reasonable notice, except in cases of urgent security measures where no advance notice may be given. 2.2 The Account Holder shall ensure that their access credentials are not disclosed to any third party and shall take all reasonable measures to protect their Authentication Instruments from unauthorized use.
The Account Holder and each Participant shall at all times (a) keep all authentication credentials strictly confidential; (b) ensure that devices used to access eBanking services are protected by up-to-date security software; (c) regularly monitor account activity and promptly report any unauthorized transactions; (d) not use eBanking services in a manner that could jeopardize the security of the Bank's systems; and (e) comply with all reasonable security instructions communicated by the Bank from time to time.
9.1 Blocking upon the Participant's request. The Bank, upon a request by the Participant, in particular in the event of a blocking notification pursuant to Section 8.1, will block (i) eBanking access for him/her or all participants, or (ii) his/her Authentication Instrument. 9.2 Blocking upon the Bank's initiative. The Bank may block eBanking access for a Participant if (i) it has the right to terminate the eBanking contract for cause, (ii) this is justified due to objective reasons in connection with the security of the Authentication Instrument or the Personalised Security Feature, or (iii) there is a suspicion that the Authentication Instrument is being used in an unauthorised or abusive manner. The Bank will inform the Account Holder of such blocking, including the reasons, prior to or at the latest immediately after the blocking. 9.3 Lifting of Blocking. The Bank shall lift the blocking or replace the blocked Authentication Instrument as soon as the reasons for the blocking no longer apply.
10.1 The Bank's liability for damages resulting from use of eBanking services shall be limited to cases of intent and gross negligence, except where mandatory statutory provisions impose a stricter standard. 10.2 The Bank shall not be liable for damages arising from failure of the Account Holder to comply with their security obligations; unauthorized access where the Account Holder contributed through their own negligence; or disruptions caused by third-party service providers or force majeure events.
